California Personal Injury Claim Deadlines
Understand why the ordinary lawsuit deadline may not be the first deadline in your case.

The general rule is not the whole answer
California personal injury lawsuits generally have a two-year filing deadline measured from the injury. Exceptions and different claim types can change the analysis. Do not use this page to calculate your specific filing date.
Government claims may require earlier action
For many injury claims against public entities, a government claim must first be presented within six months. A later lawsuit has its own deadline. Exceptions, notice requirements, and the agency’s response matter. A public bus, public property, or government employee can raise these issues.
What to tell the attorney
Provide the injury date, discovery date if different, parties involved, and every notice or rejection you received. Mention any public agency involvement. A consultation can identify which deadlines need immediate attention. Settlement discussions do not by themselves establish that a filing deadline is extended.
