Your own policy may be part of the claim
An uninsured or underinsured motorist claim involves coverage under a policy that may protect you when an at-fault driver has no liability insurance or insufficient insurance. Whether coverage applies depends on policy terms, limits, and the facts. Do not assume that a declarations page alone answers every coverage question.
What to gather before your consultation
Bring your declarations page, policy documents if available, crash report, photographs, and letters from both insurers. Tell us whether the other driver was identified, whether liability coverage was confirmed, and whether any settlement has been proposed. Include the dates of every accident notice, coverage denial, or payment.
Why an ordinary injury claim and an insurance claim are different
A claim against another driver and a claim under your own policy can involve different duties, procedures, and deadlines. Before signing a release or resolving the other driver’s claim, ask how it may affect available coverage. Cooperate with applicable policy requirements, but get advice when you are unsure what a request means.
Questions we can discuss
Which policy may apply? What information is missing? Does an offer account for the injuries and documented losses? What notices or steps need attention now? These questions are more useful than assuming a particular policy limit guarantees a payment.
